1. About these Terms

These Terms & Conditions ("Terms") govern your access to and use of the services provided by Growth Pilot AI Limited (company number 17134407), Waterdells, Pottersheath Road, Welwyn, England, AL6 9TA ("Growth Pilot", "we", "us"). By using our services you agree to these Terms. Where we process personal data on your behalf, our Data Processing Agreement ("DPA") also applies and forms part of these Terms.

2. Our services

We provide growth-marketing and lead-generation services, which may include AI-powered outreach automation, CRM and lead-generation tools, and data enrichment and workflow automation. Access is provided by subscription, trial, or custom arrangement as agreed.

3. Your use of the services

You must provide accurate information and comply with all applicable laws, including the UK GDPR, PECR and anti-spam laws. You are responsible for the content and targeting of your campaigns and for ensuring that your instructions to us are lawful.

4. Acceptable use

You must not use the services to: send unlawful communications, or communications that do not comply with applicable law (including PECR and anti-spam laws); infringe the intellectual property or other rights of any person; reverse engineer or attempt to derive the source code of our platform; or engage in fraudulent, deceptive or harmful activity. For the avoidance of doubt, lawful business-to-business outreach conducted through the platform in accordance with your instructions and applicable law is permitted.

5. Data protection

You are the data controller for the personal data processed through the services, including data you upload and prospect data we source or enrich on your documented instructions. Growth Pilot acts as your data processor and processes personal data only on your instructions, as set out in the DPA. You are responsible for: establishing a lawful basis for outreach; compliance with the UK GDPR, PECR and anti-spam laws; managing consent where required; and maintaining a privacy notice that informs individuals of your processing. We will assist you, as your processor, in accordance with the DPA. We may use our own personnel and third-party providers, including some located outside the UK, to deliver and support the services; where they process personal data they do so under the DPA and subject to appropriate safeguards for any transfer outside the UK.

6. Intellectual property

All platform technology, AI models and software remain the property of Growth Pilot. You retain ownership of your data and may extract it as described in your service arrangement.

7. Fees and payment

Subscription and other fees apply as agreed and are payable in accordance with your order. Fees are non-refundable unless stated otherwise. We may suspend access for non-payment.

8. Suspension and termination

We may suspend or terminate access for breach of these Terms, misuse of the services, or non-payment. You may cancel in accordance with the terms of your order or subscription.

9. Liability

We are not liable for indirect or consequential losses. Our total aggregate liability under these Terms is limited to the fees paid by you in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms limits any liability that cannot be excluded by law.

10. Third-party integrations and account risk

Some of our services are delivered using integrations with third-party platforms and providers, including professional-networking platforms such as LinkedIn, em-mail and data scrape platforms. These platforms are operated by third parties, set their own rules, and may restrict, suspend, ban or block an account at their sole discretion.

You are responsible for your own accounts and for your use of any third-party platform in connection with the services. Any issue arising from a third-party platform’s action, including any restriction, suspension, ban, block or loss of access, connections or data, is at your own risk. To the fullest extent permitted by law, Growth Pilot is not liable for any such action or loss.

11. Changes

We may update the services and these Terms from time to time. Where changes are material we will notify you, and continued use of the services constitutes acceptance.

12. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
